We offer our clients effective legal and ethical credit control and debt recovery procedures.
In addition to being bound by UK/EU Legislation and our Office of Fair Trading Licence, we are also bound by a code of practice from our Membership of the recognised industry association, The Credit Services Association.
Our collection ethos is to use procedures that are successful, but tempered with the concept that negotiation is usually more successful than legal action and both our clients reputation and our own is of greater importance than any single debt.
Consequently, our collectors are specifically trained in effective telephone techniques to obtain results. We only use letter, fax, telephone and e.mail to contact debtors, we do not offer a personal collection service (door knocking).
Whichever method we use, the primary function is to establish contact with the debtor. From our experience, an initial softer approach often leads to a dialogue and resolution of a debt rather than a heated situation that causes an entrenched and insoluble position.
LEGAL ACTION
Legal action is seen as a last resort and will only be recommended where we believe that despite our best endeavours we believe that the debtor has the means to pay, but we have been unable to obtain payment.
Our No Result No Fee collection service, means exactly what it says. If we recommend legal action, you do not get a bill from us. We do not process legal work ourselves, you will be invited to use the services of a Solicitor of your own choice or we can recommend a Solicitor that we feel has the necessary experience, given the nature of the debt concerned.
The major criteria for recommending legal action is the debtors ability to pay. Whilst Judgment can be obtained (at a price) satisfaction (payment) is another matter, with only approximately one in five Judgments being paid.
The costs of litigation are obviously dependent upon the individual debt value and the complexity of the case. The major factor is whether the case will be defended. In all cases, it is important that the solicitor discusses the potential costs before legal action is started.
